I’ve Been Everywhere – Divorce in a Mobile Society

In our mobile society, married couples often move from one state to another in connection with employment. When a couple separates, one party may return to their home state to be with family or friends. Sometimes, a spouse may take a job elsewhere while the rest of the family stays put. Divorce in a mobile society can pose challenges.

What happens when you are in Baton Rouge and your spouse sues you in Houston? Louisiana courts have special rules that apply in such circumstances. If you are the person living outside Louisiana, it is a good idea to consult with a lawyer in your home state concerning whether you have lived there long enough for its laws to apply to custody, child support, and status. Whether they do or not, you should also consult with a Louisiana lawyer in the parish where the lawsuit is pending. That lawyer can help you and your home state attorney make decisions on whether you should fight over which court renders the decision.

Unfortunately, interstate disputes in domestic cases are expensive to litigate because you need legal advice in both places. Don’t be penny wise and pound foolish, however. The end result may be one you must live with for a long time. It is important to get it right the first time.
